On November 15, a Federal Court in Texas blocked the recent U.S. Department of Labor (DOL) rule that increased the salary threshold for exempt workers to $844 per week as of July 1, 2024 and the second increase to $1,128 per week that was to go into effect on January 1, 2025. This is a nationwide ruling that will now cause the salary threshold to go back to $684 per week ($35,568 per year) effective immediately. It is expected that the DOL will appeal the ruling but an appeal could take 9-12 months and it is unknown what the Trump administration will decide when President-elect Trump takes office in January.
Please remember that it is still important for parishes to review and determine whether exempt employees meet the duties test, which was not changed by the DOL rule or the November 15 court decision.
